Terms of Service

You must be at least 13 years old to use MindFrame. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. MindFrame is not intended for users under 13 under any circumstances.

• You are responsible for all activity that occurs under your account.
• You must provide accurate and current information when creating an account.
• You must keep your password confidential. Notify us immediately at support@usemindframe.com if you suspect unauthorised access.
• One account per person. Sharing accounts is not permitted.

You agree not to:

• Use MindFrame for any unlawful purpose or in violation of any applicable law
• Attempt to access another user's account or data
• Reverse-engineer, decompile, or disassemble MindFrame
• Scrape, crawl, or systematically extract data from MindFrame
• Use automated tools to complete challenges or manipulate scores
• Circumvent any rate limits, access controls, or security measures
• Submit challenges or content that is harmful, offensive, discriminatory, or illegal
• Impersonate any person or entity
• Use MindFrame to compete with VaultSpark or build a substantially similar product

By participating in the MindFrame referral programme you agree that:

• You will only share your referral link with people who genuinely want to use MindFrame.
• Referral rewards (currently 500 XP for the referrer; 7-day Pro trial for the referee) are subject to change at any time.
• Fraudulent referrals (self-referral, automated accounts) will result in account termination.

Access to the MindFrame Research API is subject to additional terms. By using the Research API you agree that:

• You will only access aggregate, anonymised data for legitimate academic or research purposes.
• You will not attempt to de-anonymise or re-identify individual users.
• Any publication or presentation based on MindFrame data must acknowledge MindFrame as the data source.
• We may suspend Research API access at any time without notice.

MindFrame is a cognitive training tool — not a medical device, psychological assessment, or clinical service. Nothing in MindFrame constitutes medical advice, psychological diagnosis, or professional consultation. MindFrame scores are not a measure of intelligence, mental health, or fitness for any professional role.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, VAULTSPARK DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT MINFRAME WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VAULTSPARK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF MINDFRAME, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF MINDFRAME WILL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

We may suspend or terminate your account at any time if you violate these Terms or if we reasonably believe your use poses a risk to MindFrame or other users. You may delete your account at any time from your profile settings.

Upon termination, your right to access MindFrame ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any dispute arising from these Terms will be resolved by binding arbitration administered by the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction for IP infringement or misuse of confidential information.

If you are a consumer in the European Union, mandatory consumer protection laws in your country of residence apply and the arbitration clause may not affect your statutory rights.

We may update these Terms periodically. We will notify you of material changes by email or by posting a notice on the site at least 14 days before the change takes effect. Your continued use of MindFrame after the effective date constitutes acceptance of the revised Terms.
